This Privacy Notice explains how Minded Motion B.V., trading as HioSwing ("HioSwing", "we", "us" or "our"), collects, uses and protects personal data when you use our website, mobile experience and related services (the "Service").

1. Who we are

Minded Motion B.V. is the controller of the personal data processed in connection with the Service. Our company details are:

2. Personal data we collect

  • Account data — name, email address, phone number, password (hashed) and account preferences.
  • Profile data — handedness, optional notes you add to a swing.
  • User content — the swing videos you upload and any messages you exchange with experts.
  • Analysis data — AI-generated and expert-generated feedback associated with your swings.
  • Transaction data — order references, the plan or analysis purchased and timestamps. Card and billing details are collected by our Merchant of Record (Paddle), not by us.
  • Support communications — emails or messages you send to us.
  • Usage and device data — IP address, browser type, device identifiers, language, pages visited, and basic interaction events used to keep the Service secure and to improve it.
  • Cookies and similar technologies — essential cookies required to keep you signed in and to remember your preferences.

3. How we use your data and our legal bases

  • To provide the Service (account creation, video upload, analyses, expert review) — performance of a contract.
  • To process payments and prevent fraud through our Merchant of Record — performance of a contract and legitimate interests.
  • To secure the Service, prevent abuse and investigate incidents — legitimate interests.
  • To improve the Service, debug issues and develop new features — legitimate interests.
  • To send service messages (transactional emails such as receipts, password resets, analysis-ready notifications) — performance of a contract.
  • To send marketing messages only where you have explicitly opted in — consent, which you can withdraw at any time.
  • To comply with legal obligations (accounting, tax, responding to lawful requests) — legal obligation.

4. Who we share your data with

We share personal data only with the categories of recipients listed below:

  • Hosting and infrastructure providers that store the database, files and run the Service on our behalf.
  • Paddle.com Market Limited, our Merchant of Record, which processes payments, calculates and remits sales tax, issues invoices and handles refund requests on our behalf.
  • AI providers that process swing videos and metadata to generate analyses, under contractual confidentiality and data-protection commitments.
  • Email and notification providers that send transactional messages on our behalf.
  • Professional advisers such as accountants and lawyers, where necessary.
  • Authorities where we are required to disclose data by law or to protect our rights and the safety of users.

We do not sell your personal data and we do not share it for cross-context behavioural advertising.

5. International transfers

Some of our processors are located outside the European Economic Area. Where this is the case we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses or adequacy decisions, and we apply additional technical and organisational measures where required.

6. How long we keep your data

  • Account data — for as long as your account exists. After deletion, basic records may be retained for up to 12 months for security and audit purposes.
  • Swing videos and analyses — for as long as your account exists, or until you delete them via your dashboard, whichever happens first.
  • Transaction records — for up to 7 years to comply with Dutch tax and accounting obligations.
  • Support communications — for up to 24 months after closure.
  • Usage and security logs — typically up to 12 months.

When data is no longer needed it is deleted or anonymised.

7. Your rights

Subject to applicable law, you have the right to:

  • access the personal data we hold about you;
  • rectify inaccurate or incomplete data;
  • request erasure of your data;
  • restrict or object to certain processing;
  • request portability of data you provided;
  • withdraw consent at any time, where processing is based on consent;
  • lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or your local supervisory authority.

8. Security

We apply appropriate technical and organisational measures to protect your personal data, including encryption in transit, access controls, hardened infrastructure and regular reviews. No system is fully secure; if you believe your account or data has been compromised, contact us immediately.

9. Children

The Service is not directed at children under 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can take appropriate action.

10. Cookies

We use a limited set of essential cookies to keep you signed in and to remember your preferences. We do not use third-party advertising cookies. Where we introduce analytics or marketing cookies in the future, we will request your consent through a cookie banner.

11. Changes to this Notice

We may update this Privacy Notice from time to time. Material changes will be announced through the Service or by email at least 14 days before they take effect.
